Anyone know what happened in SD41 last night? The Dems were due to pick three names from which the Councy Commissioners would pick Ken Toole’s successor…

Fundamental misunderstanding of both the constitution and fiscal federalism. Nothing in the Constitution prohibits the federal government from offering the states funds with certain conditions attached.

The three names are (in no particular order) Rep. Christine Kauffman, Dr. Ray Peck, and Mr. Gene Fenderson. The commisioners will meet to decide on Senator Toole’s replacement at 9 AM Tuesday Dec.19. IF Rep. Kauffman is selected, three MORE names will be selected by vote of precinct people that same night (Tues Dec 19) from which the commisioners will select Rep. Kauffman’s replacement.

What were the Republicans thinking? You finally get back into power and one of your first acts is to make trouble for yourselves? Hope they don’t plan on getting re-elected in 2008.

Tenth Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

If you can’t show where the Constitution explicitly authorizes the federal government to offer the states funds with conditions attached, it is prohibited by the tenth amendment.
